Creator Terms.

1. Who These Terms Apply To

These terms govern your participation as a content creator on the POP Creators platform, operated by Poptech Growth Pvt. Ltd. ("POP", "we", "us"). "You" refers to any creator who has registered an account on our platform.

2. Eligibility

To participate as a creator you must:

• Be 18 years or older
• Have an active Instagram account that is public
• Be a resident of India with a valid UPI-linked phone number for payouts
• Not be involved in any activity that violates Instagram's Community Guidelines or Terms of Use

We reserve the right to verify eligibility and reject or remove any creator who does not meet these requirements.

3. Application & Approval

Signing up creates an application — it does not automatically grant you creator status. Our team reviews every application and approves creators at our sole discretion based on content quality, audience fit, and account health.

We will notify you of approval or rejection within 48 hours of your application. We are not obligated to provide reasons for rejection.

4. Campaign Participation

Once approved, you may opt into live campaigns. By opting into a campaign, you agree to:

• Create original content that aligns with the campaign brief and guidelines
• Post the content on your Instagram account as a public post or Reel
• Submit the live content link through your POP dashboard within the campaign duration
• Not delete or archive the content for a minimum of 90 days after posting
• Clearly disclose the content as a paid partnership in accordance with ASCI guidelines and Instagram's branded content policies

5. Content Standards

All content submitted for POP campaigns must:

• Be original and created specifically for the campaign
• Accurately represent POP's products and services
• Not include misleading claims, false information, or exaggerated product benefits
• Comply with all applicable laws including advertising standards (ASCI)
• Not contain content that is defamatory, obscene, or harmful

POP reserves the right to reject content that does not meet these standards and withhold payout for rejected submissions.

6. Payouts

Payouts are structured as follows:

• Base payout — guaranteed on content approval, paid within 7 business days
• Milestone bonuses — additional payouts triggered when your content crosses view thresholds (100K, 500K, 1M views)
• View counts are self-reported via your dashboard and subject to verification by POP
• POP reserves the right to audit view counts and withhold milestone bonuses if counts cannot be verified or appear inflated

All payouts are made via UPI to the phone number registered on your account. You are responsible for ensuring your UPI details are correct. POP is not liable for failed transfers due to incorrect account information.

Payouts are inclusive of all applicable taxes. You are responsible for reporting income from POP campaigns in your tax filings as per applicable Indian tax laws.

7. Intellectual Property

You retain full ownership of the content you create. By submitting content to a POP campaign, you grant Poptech Growth Pvt. Ltd. a non-exclusive, royalty-free licence to use, share, and promote the content across POP's own channels (website, social media, marketing materials) for the duration of the campaign and up to 12 months thereafter.

POP will always credit you when sharing your content. We will not sell or license your content to third parties without your explicit written consent.

8. Prohibited Conduct

You must not:

• Purchase fake views, likes, or engagement on any content submitted to POP
• Submit content that has been previously posted or repurposed from other campaigns
• Misrepresent view counts or engagement metrics
• Share confidential campaign briefs or payout details publicly
• Disparage POP, its products, or its team members on any public platform
• Participate simultaneously in competing campaigns that conflict with POP's brand partnerships

Violation of any of the above may result in immediate termination of your creator account, forfeiture of pending payouts, and potential legal action.

9. Account Suspension & Termination

POP may suspend or terminate your creator account at any time if:

• You breach any of these terms
• Your Instagram account becomes private, inactive, or is suspended
• Your content quality or engagement falls below acceptable standards
• We receive credible complaints about your conduct

You may close your account at any time by emailing creators@popclub.co. Pending approved payouts will be processed before closure.

10. Limitation of Liability

POP's total liability to you for any claim arising from your participation in the platform shall not exceed the total amount paid to you in the 3 months preceding the claim.

POP is not liable for any indirect, incidental, or consequential damages including loss of earnings, reputation damage, or loss of data.

11. Governing Law

These terms are governed by the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.

12. Changes to These Terms

We may update these terms as our platform evolves. We will notify active creators of material changes by email at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance.
